HOW TO FILE AN APPEAL

Notices of Appeals filed by counsel should be filed electronically.
Notices of Appeals filed by Pro Se litigants should be filed in the appropriate Divison's Intake Section.

Western Division: Civil Intake Spring Street Building, 312 N. Spring Street, Los Angeles, 90012
Criminal Intake 255 E. Temple Street, Room 178, Los Angeles, CA 90012

Southern Division: 411 W. 4th Street, Room 1035, Santa Ana, 92701

Eastern Division: 3470 Twelfth Street, Riverside, 92501

The fee to file an appeal to the Ninth Circuit Court of Appeals is $455.00 for civil and criminal cases.

Appeals filed by counsel must include the following: Representation Statement pursuant to Local Circuit Rule 3-2 and Civl Appeals Docketing Statement pursuant Local Circuit Rule 3-4. Pro Se litigants are not subject to these two rules.

Notices of Appeal must contain the following:
  • Notice of Appeal
  • A copy of the Judgment or Order being appealed
  • Service List
This package must be filed in original and one copy and be blue-backed. Pursuant to Federal Rule of Appellate Procedure 3(a).

Notices of Appeal to the Ninth Circuit Court of Appeals are to be filed in the Clerk's Office of the district court. Pro Se litigants, please submit a self-addressed, stamped envelope for returning conformed copies. No personal checks or checks drawn on non-business accounts will be accepted from either attorney or the public. The Clerk's Office will also accept all federal, state, and local goverment issued checks, bank certified checks, and U.S. Postal Service money orders. Make checks payable to: Clerk, U.S. District Court. DO NOT ATTACH CASH TO THESE DOCUMENTS. If payment is not received, you will be billed.

Additional copies are not needed because service will be made either electronically or via the U.S. Postal Service.


TRANSCRIPT DESIGNATION

For information on how to designate transcripts for the record on appeal, please refer to the Ninth Circuit Rule 10-3 and follow the instructions on the lower left hand corner of the Transcript Designation and Ordering Form. This form can be also obtained at the Appeals Section located in the Clerk's Office.

All documents presented for filing with the Appeals Section of the Clerk's Office MUST comply with the Federal Rules of Appellate Procedure and the Local Rules of the Ninth Circuit Court of Appeals and of this District Court.
