Civil motions and discovery motions are both heard on Wednesdays at 9:30 a.m. If a motion is noticed for that date and time, it is not necessary to clear the hearing date with the Court’s deputy clerk prior to filing the motion..
To file civil motions, the parties must comply with Local Rule 7, and to file discovery motions, the parties must comply with Local Rule 37. The provisions of Local Rule 6 governing the service of a notice of motion by mail shall govern a notice of motion served electronically.
All documents which are required to be filed in an electronic format pursuant to General Order 08-02 shall be filed electronically no later than 4:00 p.m. on the date due unless otherwise ordered by the Court. Any documents filed electronically after 4:00 p.m. on the date due will be considered late and may be stricken by the Court.
All parties must deliver courtesy copies to Chambers (Room 323, Spring Street) of all documents filed in the Judge’s civil cases (RC) and all discovery-related documents filed in the Judge’s discovery cases (RCx). The “mandatory Chambers copy” shall be delivered to the drop box in the hall outside Chambers no later than noon of the court day following the e-filing of the document.
Tentative rulings are usually issued prior to the hearing on any civil motion or discovery motion.
Good cause for ex parte applications is required, and the parties will be notified telephonically if a hearing is necessary.
To request a continuance of any scheduled court proceeding, the movant must submit a stipulation and the proposed order.
The date and time of a hearing on a criminal motion or guilty plea will be set by the Court.
Any inquiry about the status of a motion, stipulation or proposed order should be made to the Court’s deputy clerk. Counsel should not contact the Judge’s law clerk or secretary, or communicate with the Court or Chambers by means of the Court’s email address.
