JUDGE LEW REQUIRES COURTESY COPIES ON ALL FILED DOCUMENTS

Judge Lew requires courtesy copies be delivered to chambers located on the 5th floor of the 312 N. Spring Street courthouse. Documents should be: 1) properly e-filed or manually filed, 2)courtesy copies delivered no later than noon the next day, and, 3) emailed to the Judge's generic email address at rswl_chambers@cacd.uscourts.gov. Any questions, please call the Courtroom Deputy Clerk for further assistance.

(Motion dates are not reserved by the Court. Counsel shall file a properly noticed motion.)

  1. **CIVIL MOTIONS are heard on Tuesdays or Wednesdays at 9:00 A.M.
    **CRIMINAL MOTIONS are heard on Tuesdays or Wednesdays at 10:00 A.M. (Judge Lew does not ordinarily hold criminal status conferences/pretrial conferences). Counsel may file a request for such a hearing in writing.
    **FINAL PRETRIAL CONFERENCES are held on Tuesdays or Wednesdays at 10:00 A.M.

  2. DISCOVERY MOTIONS are to be scheduled before the assigned Magistrate Judge.

  3. Judge Lew DOES NOT issue tentative rulings.

  4. To request a continuance of any scheduled court proceedings, the parties should properly file a Stipulation and properly file a Notice of Lodging of the proposed Order. Counsel should then email to rswl_chambers@cacd.uscourts.gov the following items: the pdf version of the Stipulation and a proposed order in word or word perfect format. Do NOT assume that your stipulation will be granted. All requests for continuances should be submitted at least FIVE (5) calendar days prior to the scheduled court proceeding.

  5. Procedures for filing an Ex Parte Application: Papers are to be properly filed (whether that is manual filing or electronic filing.) Counsel should refer to Local Rules 7-19 and 7-20. As a general policy, all oppositions are due within 24 hours from the filing of the Ex Parte. Also, opposing counsel shall contact the Courtroom Deputy Clerk within 24 hours as to their position. Opposing party is to be notified that they have 24 hours to file an opposition. Judge Lew will rule on the pleadings that are submitted to the Court. Ex Parte Applications should not include a hearing date. Judge Lew DOES NOT hold hearings on Ex Parte Applications. Counsel will be notified by telephone of Judge Lew’s ruling.

  6. Counsel shall not contact, via telephone or mail, the Judge or his chambers, including but not limited to his law clerks or secretary. All inquiries are to be made directly through the Courtroom Deputy Clerk.

  7. Counsel shall contact the Courtroom Deputy Clerk, via email or telephone, at least THREE (3) calendar days prior to a hearing date if a calendar conflict is pending so that alternate arrangements can be made. Counsel are to make appearances based upon the Seniority List as established by the Chief Judge.

  8. To obtain a transcript of any reported or digitally recorded proceeding, please contact the assigned court reporter/recorder. To determine the court reporter/recorder for a particular proceeding, go to the Court Reporter Schedule web page and click on View by Date. Once you've determined the correct court reporter/recorder for the desired session, click on Court Reporter Phone and Email List for contact information.


  9. ADR PILOT PROGRAM
    If counsel has received a "Notice to Parties of Alternate Dispute Resolution (ADR) Pilot Program" - forms ADR-08, ADR-10, or ADR-11, with an attached "ADR Pilot Program Questionnaire" - form ADR-09, please see General Order 02-07, which is located in the "General Orders" section on the home page of the Court's website. The Attorney Settlement Officer information is located in the section "Attorney Information, ADR." (upper left hand side of the home page.)

  10. TRIAL PREPARATION INSTRUCTIONS
    MOTIONS IN LIMINE: All motions in limine shall be properly filed no later than the date of the Final Pretrial Conference. Oppositions shall be properly filed no later than 7 days after the Final Pretrial Conference; replies, if any, shall be properly filed no later than 14 days after the Final Pretrial Conference.

    EXHIBITS: Counsel are to prepare their exhibits for presentation at trial by placing them in volumes which are tabbed down the front, right side with the exhibit numbers. These volumes are to be prepared in an original and one (1) copy for the Court. Each volume of exhibits shall be contained in a three-ring notebook. Exhibits must be numbered in accordance with Local Rules 11-5.2 and 11.5.3.

    THE COURT REQUIRES THAT THE FOLLOWING BE SUBMITTED TO THE COURTROOM DEPUTY CLERK ON THE FIRST DAY OF TRIAL:

    1. TWO separate books of exhibits . The first book shall contain the original exhibits which shall be used by the witness. The second book shall be used by the Judge.
    2. THREE *copies of your EXHIBIT LIST (*no file stamp on these copies)
    3. THREE *copies of your WITNESS LIST (*no file stamp on these copies)

    On first day of trial, counsel are to arrive no later than 8:45 a.m.

  11. To obtain the services of an interpreter in a civil case contact the Interpreters Department at 213-894-4599.

  12. Counsel shall contact the Courtroom Deputy Clerk, via email or telephone, to request leave to bring electronic equipment into the courtroom. Counsel are advised that such a request shall be made by a letter addressed to the U.S. Marshal's Office and forwarded to the Courtroom Deputy Clerk for signature (please include case name and case number) Upon request, counsel may fax the letter to the Courtroom Deputy Clerk. Upon arrival at the courthouse, counsel shall present the letter to the Court Security Officer for entrance.

  13. All exhibits will be returned to counsel at the end of trial and will not be kept by the Court. Counsel are to keep the lodged and admitted exhibits in their possession pursuant to Local Rules 79-3 and 79-4.

  15. Judge Lew follows the Local Rules and does not have any other special rules.

  16. Judge Lew DOES NOT allow telephonic appearances.

  17. In addition to hard copy submissions, parties must submit a copy of the proposed jury instructions in conformance with Local Rules 51-1 through 51-5.1 on disc in WordPerfect format. Please see the attached jury instruction for guidance.
