Court clerk seats all prospective jurors by random draw. Jurors are handed trial calendar [optional] and a sheet of paper that calls for their later recitation of personal information, such as city of residence, place and type of work, etc.
Court conducts voir dire of entire panel, not just jurors in jury box. The Judge may invite counsel to ask questions. After challenges for cause are heard at sidebar, counsel submit their written peremptory challenges. The Clerk collects the forms from counsel and gives forms to the Judge. Judge and Clerk confer so as to assign the unstruck, unchallenged jurors selected by the parties.
At sidebar, the Court confirms peremptory challenges as submitted. Judge names first 6-8 unstruck, unchallenged jurors (civil) or first 12-14 unstruck, unchallenged jurors plus alternates (criminal) who constitute the jury. In criminal cases, an alternate pool can be reserved.
Alternates are not identified as alternate jurors. |
