  1. Civil motions are heard on Wednesdays at 10:00 a.m. It is not necessary to clear a civil motion date with the court clerk prior to filing the motion. Criminal motions are scheduled as required.

  2. Discovery motions are to be scheduled before the magistrate judge, if referred by the district court judge. Strict compliance with Local Rule 37-1 et seq is required. Discovery motions are heard on Wednesdays at 10:00 a.m. It is not necessary to clear a discovery motion date with the court’s clerk prior to filing the motion.

  3. Tentative rulings may be issued.

  4. A mandatory chambers copy of all e-filed documents shall be delivered to the courtesy copy box outside chambers (9th Floor of Spring Street Courthouse) no later than noon the day following the electronic filing of the document.

    All proposed signature items shall be e-mailed to the chambers email address at fmo_chambers@cacd.uscourts.gov [fmo(underscore)chambers@cacd.uscourts.gov] in Word or Word Perfect format.

    The mandatory chambers copy must be clearly marked MANDATORY CHAMBERS COPY.

  5. Ex parte applications are not heard unless ordered by the court. Counsel should refer to Local Rules 7-19 and 7-20. Oppositions (with a mandatory chambers copy delivered to chambers), if any, are due no later than 5:00 p.m. on the first business day following the service of the ex parte application. For example, if an ex parte application is served on a Wednesday at 2:00 p.m., the opposition must be filed and served (with a mandatory chambers copy delivered to chambers) no later than Thursday at 5:00 p.m.

  6. Ex parte applications are an unacceptable method of bringing a discovery dispute to the attention of the court absent an extreme emergency.

  7. To request a continuance of any scheduled court proceeding, parties should submit a signed stipulation and proposed order. If it is necessary to file an ex parte application to request a continuance, the application should, in addition to complying with Local Rule 7-11 and number 5 above, set forth the opposing counsel’s position.


  8. Counsel are not allowed to contact the judge’s law clerks.


  9. Information regarding the status of civil motions, civil stipulations or civil proposed orders are not available by telephone. Counsel shall follow the Local Rules and Federal Rules of Civil Procedure. (Local Rule 11-4.5).

  10. Calendar conflicts: Advise the court clerk in advance about a calendar conflict and attempt to stipulate to an alternative date and time with opposing counsel after clearing the alternative date and time with the court’s clerk.


  11. Counsel should contact the court’s clerk regarding procedures for bringing electronic equipment into the courtroom.
