  1. Civil motions are heard on Mondays at 1:30 p.m.
    Criminal motions are heard on Mondays at 10:00 a.m.
    Civil and Criminal Motions in Limine are heard on the first day of trial at 9:00 a.m.
    It is not necessary to clear or reserve a motion date. However, parties are directed to review the closed motion dates before e-filing a motion.
    If Monday is a holiday, please use the next available Monday.

  2. Discovery motions are to be calendared before the magistrate judge.


  3. Please see the attached Initial Standing Order for detailed procedures regarding cases assigned to Judge Gutierrez.

  4. Civil and criminal trials are held Tuesday through Friday from 9:00 a.m. to 12:00 Noon and from 1:30 p.m. to 4:30 p.m. Motions in Limine will be heard on the first day of trial. Please see the Judge’s Orders regarding court or jury trials. These Orders contain information regarding exhibit preparation, jury instructions, and verdict forms.

  5. Pursuant to the General Order, mandatory chambers copies of ALL criminal and civil ELECTRONICALLY FILED documents should be delivered directly to chambers no later than the following day before 12:00 p.m. The mandatory chambers copies shall include the e-filing confirmation sheet and/or the e-filing header at the top of each document. Counsel are advised that failure to comply may result in the document being stricken from the record and/or in the imposition of sanctions.

  6. Inquiries regarding the status on a motion, stipulation, or proposed order are not handled telephonically. Counsel may review the Court’s docket via PACER, in order to obtain updated case information. Parties may register for access to PACER by visiting the court’s website at www.cacd.uscourts.gov > General Information > PACER.

  7. Ex Parte Applications are only for extraordinary relief. Sanctions may be imposed for misuse of Ex Parte Applications. See Mission Power Engineering Co. v. Continental Casualty Co., 883 F. Supp. 488 (C.D. Cal. 1995). Ex Parte Applications shall be electronically filed and the attachments shall include a Proposed Order and a Declaration indicating the necessity of the Ex Parte Application, stating that opposing counsel has been notified and/or whether there is an Opposition to the Application. Ex Parte Applications are typically considered on the papers. Therefore, if the Court finds that a hearing is necessary, then the parties shall be notified. Opposition to an Ex Parte Application shall be electronically filed no later than 3:00 p.m. on the first business day following service of the Application. Ex Parte Applications and Oppositions shall be delivered directly to chambers. Counsel shall be notified by minute order of the Court's ruling.

  8. Calendar conflicts should be immediately brought to the attention of the court clerk by telephone. Please include the name of the judge and the conflicting time.

  9. Counsel shall not contact the Judge’s chambers’ staff for any reason. All inquiries shall be directed to the court clerk.

  10. Counsel shall electronically filed a Stipulation and Proposed Order if they are seeking a hearing continuance or extension of time. Mandatory chambers copies shall be delivered directly to chambers the following day before 12:00 p.m.

  11. To obtain a transcript of any reported or digitally recorded proceeding, please contact the assigned court reporter/recorder. To determine the court reporter/recorder for a particular proceeding, go to the Court Reporter Schedule web page and click on View by Date. Once you've determined the correct court reporter/recorder for the desired session, click on Court Reporter Phone and Email List for contact information.


  12. Law Clerk and Extern Applicants may submit applications to District Judge Philip S. Gutierrez, United States District Court, Room 7100 at 255 East Temple Street, Los Angeles, California 90012. Please include a cover letter, resume, transcript, and writing sample. Letters of recommendation are to be directed to this address.

  13. To obtain the services of a court-certified interpreter on a civil case, please visit the Court’s website at www.cacd.uscourts.gov > General Information > Interpreters.

  14. Electronic equipment is not allowed into the courtroom, without first obtaining the Court's approval via Stipulation and Proposed Order.

  15. If counsel has received a “Notice to Parties of Alternate Dispute Resolution (ADR) Pilot Program” - forms ADR-08, ADR-10, or ADR-11, with an attached “ADR Pilot Program Questionnaire” form ADR-09, please see General Order 02-07, which is located in the “General Orders” section on the home page of the Court’s website.
