Notice from the Clerk

RE: PROOF OF SERVICE OF PROCESS

Effective May 1, 2001, all returns of service of process for Summons, Complaints, Cross-Claims, Counterclaims, Third-Party Complaints, Alias Summons, will require the following information for a default by the Clerk to be entered:

  1. The statute under which the process was served, Federal Rule of Civil Procedure 4(e)(1), California Code of Procedures 415.et seq., 416. et seq. or other California Code.

  2. For substituted service, if the name of the person cannot be ascertained, the “general” description of said person must include: sex, ethnic origin, approximate height, approximate weight, hair color and age.

  3. If service is under a California Code of Procedures, the due diligence and mailing requirements must be met.

All requirements of service under F.R.Civ.P. 4(e), C.C.P. 415 et. seq., 416. et seq. or other California Code must be complied with in order for a default to be entered by the Clerk.

It is recommended that Court form CV-1, Proof of Service - Summons and Complaint be used.
